Terms of Service
The Class Alchemy is a product of Luna Aerial Dance & Performing Arts LLC, a Maryland limited liability company. These Terms of Service (“Terms”) govern your access to and use of The Class Alchemy™ website, software, and related services (collectively, the “Service”) operated by Luna Aerial Dance & Performing Arts LLC and its product The Class Alchemy™ (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of terms
If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; the “Last updated” date above will change when we do. Continued use after changes constitutes acceptance of the revised Terms.
2. Description of service
The Class Alchemy™ provides tools for aerial and pole instructors and studios to plan classes, manage curricula and skills, and related features as described on our website. We may add, modify, or discontinue features with reasonable notice where practicable.
3. User accounts
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Notify us promptly at hello@theclassalchemy.com if you suspect unauthorized access.
4. Payment and billing
Paid plans are billed according to the pricing and billing cycle shown at checkout or in your account. Fees are exclusive of applicable taxes unless stated otherwise. Failure to pay may result in suspension or termination of access.
5. Cancellation
You may cancel your subscription through your account settings. Cancellation takes effect at the end of the current billing period unless otherwise stated. See our Refund Policy for information on refunds.
6. Intellectual property
The Service, including its design, text, graphics, logos, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business or personal instructional purposes in accordance with these Terms. You may not copy, reverse engineer, or resell the Service except as permitted by law.
You retain ownership of content you submit (“Your Content”). You grant us a license to host, process, and display Your Content solely to operate and improve the Service.
7. Acceptable use
You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with other users, transmitting malware, or using the Service in violation of law. We may suspend or terminate accounts that violate these Terms.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by applicable law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim or (b) one hundred U.S. dollars (USD $100), except where liability cannot be limited by law.
10. Indemnity
You agree to defend and indemnify us against claims arising from Your Content or your violation of these Terms or applicable law, to the extent permitted by law.
11. Governing law
These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. You agree that courts located in Maryland shall have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to mandatory consumer protections in your jurisdiction where applicable.
